The general filing fee is $0, but Pub. L. 119-21 adds two fees that CANNOT be waived: a $100 Asylum Application Fee due at filing from the principal applicant only, and an Annual Asylum Fee for every year the application stays pending. As of Feb. 5, 2026 neither applies to Ms. L. Settlement Class members or their Qualifying Additional Family Members.

Fees charged on top of the filing fee

Asylum Application Fee under Pub. L. 119-21 — due at filing, principal applicant only, cannot be waived+$100
Annual Asylum Fee under Pub. L. 119-21 — principal applicant only, billed by USCIS notice for each year the application is pending and paid online at my.uscis.gov within 30 days; cannot be waived, and the amount is adjusted each year by law+$105
These are added to the filing fee above, not subtracted from it — if one applies to you, your real total is the filing fee plus the amount shown, submitted as a separate payment. Confirm your own total at the official USCIS fee calculator before you file.
Fees shown are taken from USCIS Form G-1055 (what that is), edition 10/07/26, verified by hand on 2026-10-08. USCIS changes fees without notice — confirm your exact total at the official USCIS fee calculator before you file. Filing fees only: they exclude attorney fees, premium processing, and Department of State fees.

What else goes in the envelope

I-589 has no general filing fee, but Pub. L. 119-21 adds a $100 Asylum Application Fee at filing and an Annual Asylum Fee for every year it stays pending. Neither can be waived.

I-589 carries no USCIS filing fee of its own; the forms it is filed with carry theirs. Confirm your own list against the official form instructions before you file.

You are about to pay $0 to file this I-589

A rejected filing comes back with the fee — but you lose the months you already waited, and priority dates, status gaps and work-permit gaps do not pause while you refile. A denial is worse: the case was accepted and adjudicated, so USCIS keeps the fee. Since 10 July 2026 a signature defect on a paper filing can be denied outright, with no chance to correct it. FormGuard checks a completed I-589 against the rejection reasons USCIS actually applies, before you mail it — $39 against the $0 you are about to spend.

What I-589 is for

Applies for asylum in the United States and for withholding of removal, and (by checking the box in Part A.I) for protection under the Convention Against Torture.

Anyone physically present in the U.S. who is not a U.S. citizen. File with USCIS only if you are NOT in EOIR proceedings — or if you are, or once were, determined to be an unaccompanied alien child. Otherwise the application goes to the immigration court, not to USCIS.

Paper or online?

I-589 costs the same either way — $0. Online filing still gives you a receipt immediately and removes the mailing-address risk entirely, which is the more common source of trouble.

I-589 fee — frequently asked questions

How much is the I-589 filing fee in 2026?

The USCIS filing fee for Form I-589 is $0, whether you file online or on paper. That is the figure on the current G-1055 fee schedule, edition 10/07/26. It covers the USCIS filing fee only — not attorney fees, premium processing, or any fees collected by the Department of State.

Does the I-589 fee include biometrics?

Yes. Since the USCIS fee rule that took effect on April 1, 2024, there is no separate biometric services fee for Form I-589 — biometrics is included in the filing fee shown above. (A separate $30 biometrics fee still applies to a small number of request types, such as Temporary Protected Status filings.)

Are there fees charged on top of the I-589 filing fee?

Yes, for some filers. The G-1055 schedule adds these to the filing fee for Form I-589 rather than replacing it: Asylum Application Fee under Pub. L. 119-21 — due at filing, principal applicant only, cannot be waived — $100; Annual Asylum Fee under Pub. L. 119-21 — principal applicant only, billed by USCIS notice for each year the application is pending and paid online at my.uscis.gov within 30 days; cannot be waived, and the amount is adjusted each year by law — $105. These are additions, not discounts — if one applies to you, your real total is the filing fee plus the amount shown, and it is submitted as a separate payment. Confirm your own total at the official USCIS fee calculator before you file.

Is the I-589 filing fee refundable if USCIS rejects or denies my form?

These are two different outcomes. If USCIS rejects your filing, the case was never accepted — USCIS returns the package and the filing fee, but you lose the months you already waited and have to start again. If USCIS denies your case, it was accepted and adjudicated, and the filing fee is not refunded. Filing it correctly the first time is what protects both the fee and the timeline.
